March 2017 - Iryna Nikolayevska, Counsel and Head of the Corporate/M&A and Compliance, Risk & Sensitive Investigations practices at Kinstellar’s Kyiv office, gave a presentation at the recent Compliance Club meeting held at the American Chamber of Commerce on 14 March in Kyiv. The subject of her talk was legal privilege during FCPA-driven investigations.
During the presentation, Iryna gave an overview of the notion of legal professional privilege and explained some practical aspects of using legal privilege in FCPA-driven investigations, including areas such as: the difference between the concepts of privilege in the UK and the US and the difference between the notions of privilege and confidentiality; the role of legal privilege in internal and regulatory investigations; the ways to establish and preserving privilege; and other related issues.
