Kinstellar organises discussion in Prague on the practicalities of implementing the European Union General Data Protection Regulation (GDPR)

June 2017 - Representatives of more than 40 leading businesses in the Czech Republic came together at a panel discussion in Prague organised by Kinstellar, together with DXC Technology, to discuss the practical issues they face in the run up to the implementation of the EU General Data Protection Regulation (GDPR).

Topics discussed included the need to review current contractual documentation (including personal data processing agreements) and internal regulations as well as the importance of setting up internal processes, IT systems, databases, etc. The discussion focused not only on new obligations and new risks associated with the GDPR—data protection and related IT system settings—but also looked at security-related issues and the practical problems that arise when implementing a technical solution for data management and management systems.

Jitka Logesová, Partner at Kinstellar’s Prague office and head of the firm’s Compliance, Risk and Sensitive Investigations practice, started things off by clarifying the importance of the GDPR in investigations, with which Kinstellar has vast experience.

Zdeněk Kučera, managing associate and head of the firm’s Technology, Media and Telecommunications and Dispute Resolution practices in Prague, followed with a review of the main changes for a company’s  business brought by the new rules. In particular, he explained the advantages of the pseudonymisation of data and also how companies appoint a data protection officer. He closed by pointing out that measures adopted by companies in the Czech Republic should reflect the ePrivacy regulation and the amendment to the Czech Data Protection Act, both of which are currently still being discussed.

Jan Pfeffer, a senior associate and privacy/data protection specialist in Kinstellar’s Prague office, then described how companies should carry out data protection audits. Jan touched on the firm’s unique experience in reviewing company-held data and gave examples of how the firm has resolved such problems for clients in the past.

Attendees shared their experiences in preparing for the legislative changes in data protection, and a lively discussion followed.
