October 2013 - On 29 October, Kinstellar’s Prague office and KPMG co-hosted a seminar on managing the risks of corruption and economic crime as part of an event organised by the publisher of Economia and Legal Advisor magazines.
Jitka Logesová, partner and head of Kinstellar’s Compliance, Risk and Sensitive Investigations practice, and Stanislav Mečl, counsel in Kinstellar’s Prague office and former Czech deputy attorney general, reviewed the latest trends in the prosecution of criminal offences by companies, especially in light of the Czech Act on the Criminal Liability of Legal Persons, which came into effect on 1 January 2012, and international anti-corruption legislation – in particular the US FCPA and the UK Bribery Act.
Attendees had an opportunity to exchange with the presenters on new trends in combating economic crime, the responsibility of companies’ management for shortcomings in the implementation and monitoring of compliance programmes, handling bribery and corruption risks in commercial transactions using intermediaries, and how to set up effective anti-corruption measures.
"Czech companies should realise the serious consequences that could arise from an investigation carried out by police into a suspected crime, and the benefits of trying to pre-empt such consequences or at least taking stock of their internal situation before law enforcement authorities do so,” comments Jitka Logesová in an article published in the latest edition of Legal Advisor magazine. "I believe that the discussion helped to demonstrate the importance of such measures and thus contributed to improving the preparedness of companies in the fight against economic crime with regard to existing legislation.”
